1. ACCEPTANCE OF TERMS
The client acknowledges having read while making his order, our general conditions of sale and expressly accept unreservedly and unconditionally.
These general terms of sale govern the contractual relationship between the seller name BorisBoy Bvba through its website www.borisboy.be and the clients represent by all person or company buying products on our website, both parties accept them fully.
These general terms of sale prevail over all other terms, unless prior written waiver.
The Products offered for sale by BorisBoy are those on the website www.borisboy.be on the day of the consultation and validation of the order by the customer.
Photographic representations illustrating the products as well as texts description are as accurate as possible, it may happen the customer perception of the product does not correspond exactly to the product itself.
In particular, the photographic representations involving physical models are intended only to inform the customer on the product type selected.
No photograph can in no case constitute a contractual document.
The seller agrees to deliver products meeting current requirements for safety and health, to fair trading and consumer protection.
The current selling price for each product shall be as shown in the Euro currency on the date of the order and includes all taxes, shipping and packaging price will be mentioned before confirming the order and charged extra.
The total amount owed by the customer is indicated on the order confirmation page.
In case of promotion of the products, the seller undertakes to apply the promotional price to all orders placed during the term thereof.
The seller reserves the right to change prices at any time, while ensuring the client application of the price prevailing on the date of the order.
The total price of the order is payable in full after confirmation.
Payment is due at the time of the order.
All orders are payable in Euro currency all taxes (VAT) plus delivery charges.
Our clients may choose between the following payments:
- Mastercard / Visa.
- Bank Transfer.
The customer guarantees the seller that he has permission to use the payment method chosen.
Penalties will be applied automatically to unpaid amounts after a period of fourteen days following the payment date or upon notification of the rejection of a bank payment.
As part of the fight against internet fraud, information relating to the order may be transfered to any third party authorized by law or designated by the seller only purpose of verification of the following : identification of the buyer, the validity of the order, the method of payment and delivery date.
All ordered products remain property of the seller until full payment of the amount due.
However, the effective date of delivery, the risks (including loss, theft or damage) concerning the Products delivered are assumed by the customer.
Orders are processed within 3 days after payment is received (excluding Saturdays, Sundays and holidays).
No shipments are made on weekends and holidays; an order placed on Friday will be processed on Monday.
Our delivery times vary from 7 to 10 days, including preparation time.
If the "free shipping" appear in the basket, the cost will be due by the seller.
Free shipping orders concerns exclusively the delivery addresses located in Brussels-Capital Region (19 municipalities) and the amount may be higher than a price determined by the seller.
Otherwise, the costs of delivery shall be notified in the "basket". Shipping fees include handling, packaging and transport.
Delivery will be made by one of these carriers : POST, DPD, GLS, UPS, DHL for Europe and some countries outside Europe.
Delivery by POST, DPD, GLS
The usual delivery time, including preparation , from Monday to Saturday for Belgium is 48 hours after the deposit of the package at the post (or 5 days after registration of the order, excluding weekends and holidays off ).
NB: We have 10 to 15 days after registration of the order, excluding weekends and holidays off to deliver the order if not in stock.
In the absence of the buyer or the recipient or when the size of the mailbox is too small the package could not be delivered, the buyer receives a calling. This review allows him to retrieve his package at the office of the designated carrier, within fifteen days. After this time, the package is returned to sender.
No dispute on the delivery itself is possible if the package appears to have been "delivered" in the computer system of the carrier.
No claims with respect to the delivery shall be entertained within a period exceeding 30 days after shipping.
If the package appears to be stuck at a stage of distribution, it is up to the customer to contact the seller who will open an investigation with the carrier.
The carrier then has a maximum of 3 weeks to send the seller the results of his research.
If after that period the carrier is not able to transmit a receipt to the seller, the parcel will be declared lost and then it will refund the order. The seller will then notify the customer immediately and will proceed with the order refund procedures corresponding to the lost parcel (products and shipping).
However, if the designated carrier address the seller a document confirming the delivery, it will not open dispute case and will not be able to refund the order.
The customer must check at the time of receipt of the order, compliance and product packaging condition. If the customer finds an abnormality in the package (open or damaged package), he should not open it and report it to the carrier within three (3) days to establish a "statement". The opening of the package cancels any possibility of recourse to the seller.
According to Article 1122 of the Civil Code: the law provides for a 14-day reflection period, which is the period before the expiry of which the recipient of the offer may declare his refusal or withdraw
For any information, question or complaint, the customer can contact on Monday to Friday from 12 am to 20 pm the Company (BorisBoy Bvba).
BorisBoy disclaims all liability due to incorrect use of the products!
These general conditions of sale and the contractual relations between the seller and the customer are subject to Belgian law.
The Tribunal of Commerce of Brussels has exclusive jurisdiction, regardless of delivery location and method of payment accepted.
The products of the sellers have a legal guarantee of 2 years.
